Jaroslaw Kaczynski will be interviewed by military prosecutors in connection with the April plane crash in which his twin brother, then Polish president Lech Kaczynski, died.

Kaczynski, a runner-up in the country’s recent snap presidential polls, lost his twin brother on April 10, when a presidential Tu-154 plane crashed in western Russia killing all 96 people onboard.

“Investigators are interested in all details related to the presidential plane crash,” a lawyer representing interests of the accident’s victims said.

The interview is scheduled for July 27.

“Naturally, investigators are interested in Jaroslaw Kaczynski, because he is the brother of the late Polish president,” Rafal Rogalski told the media.

“Some members of the families of the Smolensk crash victims have already testified. Prosecutors ask them if they possess information which can be useful for the investigation into the cause of the catastrophe. They can choose themselves whether to be interrogated or not and when,” Poland’s thenews.pl English-language portal quoted Rogalski as saying.

Polish authorities are investigating whether “artificial fog” could have caused the April plane crash that killed president Lech Kaczynski and 95 others, according to reports.

Poland reportedly wants access to US satellite photography that might cast new light on the weather conditions at the time of the crash, according to Gazeta Prawna, a Polish newspaper.

 Prosecutors want help from American experts as to whether “there is a scientific and technical capacity to generate artificial fog”, the paper said.

Burgermeister to sue the state of Austria over illegal court guardianship appointments

Jane Burgermeister is looking into suing not just Judge Michaela Lauer, Mag Daniela Ehrlich and associates for their role in the illegal appointment of a court guardianship for her aunt and for herself and in connection with the manipulation of files for her father’s estate, but also the state of Austria.

She will seek damages for emotional stress and loss of earnings by suing the Austrian state, arguing the state is ultimately responsible for a situation where there is no adequate control left over judges.

The onus should not be on Burgermeister to defend her aunt and herself from illegal court guardianship appointments based on obvious falsehoods and file manipulation by a judge as can be proven by documents, faxes and emails and court records. She should not have to file appeals, criminal charges and sue for compensation to stop herself being stripped of her rights. The Austrian state has a duty to  protect its citizens — especially investigative journalists — from such a flagrant abuse of power by a judge that have resuted in Burgermeister’s aunt and in her of being stripped of all her basic rights.

The Nuremberg Judges Trial of 1947 examined the  responsibility of state judges and lawyers in allowing crimes against citizens to be committed on a gigantic scale in Nazi Germany. These principles still apply. As a citizen of Austria, Burgermeister has a constitutional right to protection of the state from attempts to strip her of her basic rights using illegal methods. The state is clearly failing in its duty.


Jane Burgermeister’s aunt signs appeal on Sunday, is on the verge of death by Thursday

Jane Burgermeister’s aunt, Bibi, signed an appeal on Sunday to reverse the appointment of Mag Daniela Ehrlich as her court guardian after shocking evidence of fraud by Dr Stephan Pflugbeil from Krankenhaus Hietzing and Judge Michala Lauer from Hietzing Court , which was documented in the appeal filed on July 5th.

On Thursday, after a mysterious accident in the Geriatrie Centre Liesing, Bibi fractured her hip and was transferred to Vienna’s biggest hospital, the AKH in Vienna.

She was about to have an operation that could have killed her — Ehrlich had already signed the permission form — when Jane Burgermeister intervened to stop it.

Bibi is now in very bad shape.

But a hip replacement operation for some one of her age — 84 — and with her current heart condition could, together with the complications, have brought her death within days.

And yet this traumatic operation was what was being planned for her on Thursday evening after Ehrlich signed the forms.

Because none of the correct procedures were followed in appointing Ehrlich, the appointment is illegal, and Ehrlich’s signature is illegal.

Lauer also said that the family members had refused the court guardianship in official court documents – but this is also false. Myself and my brothers have actively sought the guardianship.

Ehrlich and Lauer will be sued for damage and their illegal actions.

Burgermeister had to bring the documents of the appeals to the hospital on Friday and give a long explanation to the doctor to regain some measure of control of her aunt’s medical treatment, and stop the operation from going ahead.

The head doctor was apparently on the phone with Ehrlich for hours, so a junior doctor told her, raising the question of what their relationship is, and how close it might be.

Burgermeister filed a second appeal yesterday, Friday, over the handling of her father’s estate by the same judge Lauer, documenting more evidence of the manipulation of files, falsehoods and abuse of office .

On June 29th Lauer started the process to put Burgermeister under a court guardianship on the grounds she is a conspiracy theorist and will cause financial damage to herself, and she is to appear before a judge on August 12th.

Her aunt, Bibi, has now broken her arm and her hip in the space of about two months, first in Krankenhaus Hietzing and then in Geriatrie Liesing, resulting in a rapid deterioration of her otherwise perfect lifelong health without any visits to doctors.

An attempt by Burgermeister to find out what happened to her aunt on Thursday was blocked by staff there : one staff member said she was not on duty on Thursday, the station nurse on duty had suddenly called in sick and she had to speak to the head of the home.

Her aunt, who is clear in mind according to the evaluation of Lauer’s own minion, Marianne Doublie, told Burgermeister, her hands had been tied. It is not clear what happened.

The Krankenhaus Hietzing closed down the ward where Bibi was on Monday without warning for two weeks and all patients were moved out.

Toxicologists: Corexit “Ruptures Red Blood Cells, Causes Internal Bleeding”, “Allows Crude Oil To Penetrate “Into The Cells” and “Every Organ System”

As I have previously noted, Corexit is toxic, is less effective than other dispersants, and is actually worsening the damage caused by the oil spill.

Now, two toxicologists are saying that Corexit is much more harmful to human health and marine life than we’ve been told.

Specifically Gulf toxicologist Dr. Susan Shaw – Founder and Director of the Marine Environmental Research Institute – dove into the oil spill to examine the chemicals present.

Dr. Shaw told CNN:

 If I can tell you what happens — because I was in the oil — to people… Shrimpers throwing their nets into water… [then] water from the nets splashed on his skin. … [He experienced a] headache that lasted 3 weeks… heart palpitations… muscle spasms… bleeding from the rectum…

And that’s what that Corexit does, it ruptures red blood cells, causes internal bleeding, and liver and kidney damage. … This stuff is so toxic combined… not the oil or dispersants alone. … Very, very toxic and goes right through skin. ***

The reason this is so toxic is because of these solvents [from dispersant] that penetrate the skin of anything that’s going through the dispersed oil takes the oil into the cells — takes the oil into the organs… and this stuff is toxic to every organ system in the body. … Similarly, marine biologist and toxicologist Dr. Chris Pincetich – who has an extensive background in testing the affects of chemicals on fish – says that Corexit disrupts cell membranes. He also explains that EPA toxicity testing for Corexit is woefully inadequate, since EPA testing for mortality usually only requires a 96-hour time frame. His doctoral research found that fish that were alive at 96 hours after exposure to pesticide were dead at two weeks, so the chemicals were considered non-lethal for the purposes of the test. Drs. Shaw and Pincetich are wildlife conservationists. But even industry scientists working for Exxon and the manufacturer of Corexit itself admit that the stuff is toxic.

Costa Ricans protest arrival of US fleet: Open letter from Claudia Calvo

Hi, Jane.

We have a dangerous situation right now in Costa Rica: our brand-new government just gave permission for an entire fleet (46 warships) of the US to operate in our waters, air and soil -“to fight drugs”. As you know, my country has had no army for 60 years, and we are a neutral nation –except a previous President saw fit to announce “Costa Rica supports the war on Iraq” –which NO citizen was consulted about, trust me: we don’t believe in war. This is particularly worrisome, because no one would even have known about it, weren’t it for the whistleblowing of 3 minority parties; the Parliament was given 2 days to vote on the issue… since the first ship was due on the second day! Of course narcotics are a problem worldwide, but we don’t see how an army can combat this (look at Colombia).  And of course, mainstream media portray it as a Very Good Thing –when they do give one or two lines to the issue.  Only Nuestro País digital has had the guts to expose it entirely.

Any trafficking –of drugs or others- is only combated by intelligence (the real kind) and most especially… by political decision NOT to support them… which might well be the reason why this is a global problem; I think you can see my point.

Anyway, let’s not forget our tiny country is quite strategically located: we are wedged right between the Panama Canal and Nicaragua (allied with Venezuela and with good relations with Iran); we are less than 500 km away from Venezuela and Colombia. Considering what is going on in the world, I suspect –and am not the only one- that this entire operation has more to do with the US “Plan Colombia” against Hugo Chavez, than with any kind of drug-stopping…  Not to mention (with the very dire finances the US has right now), I really don’t see where they would fish the funds… if it really were for an innocent drug operation on this massive scale –we’re talking at least 46 warships, including aircraft carriers, 2 hospital ships (?),  200 armored helicopters and 10 military planes….

Critics accuse Laura Chinchilla’s government of violating our Constitution

San José (elpais.cr) – While President Laura Chinchilla assured on Tuesday that the entry of more than 13.000 American “marines” is a normal action, which was registered last decade, opposing deputies maintain that the Law regulating the agreement of drug trafficking fight -expired this past September.  
 
Chinchilla indicated on Tuesday that the joint patrol agreement with the US Coast Guard will serve the alleged combat against narcotic traffic and denies the Treaty represents any threat to the country’s sovereignty:  
“I guarantee these treaties are the same (that were signed in the last 10 years) and I will never expose the country to a constitutional breach, and much less t o a militarization of the drug-trafficking fight”, declared Chinchilla on a radio show. 
 
The Parliament agreed past Wednesday and Thursday to allow entrance to national waters and territory for the “visit” of more than 13 thousand US military in 46 warships, between July 1 and December 31 of 2010. 
 
Legislators of Parties Unidad Social Cristiana and Frente Amplio, Luís Fishman and José María Villalta, respectively, denounced this Tuesday that the Patrol Treaty, sanctioned by the Law 7929, expired on September 28 of past year, and hasn’t been modified.  
 
Fishman, ex Minister of Public Security and ex presidential candidate for his party, reminded he himself had signed the original Treaty, which clearly established that the joint combat against drug traffic did NOT involve any kind of military force.  
 
Tuesday, the Socialchristian legislator reiterated the Treaty is no longer valid, even though an officialist deputy, Francisco Chacón, says this was modified on September 16 1999, but Fishman clarified that the Law came after, on September 28 of that same year, “and is what counts”. 
 
He said the Treaty might have been varied by the Foreign Minister, “but there is no extra- parliamentary mechanism that can modify a Law”.  “This is a legal matter. Things have to be done the right way.  The Assembly must give priority to examine and reexamine this agreement, and the reform Chacón mentions is not integrated within the Law”, he insisted.  
 
Fishman also warned that, to legalize the entry of such an amount of warships and troops, the Asamblea Legislativa must vote the permissions of each warship one by one for entry, and not in the way it was done last week. 
 
The Congress’ decision “goes further” than the joint patrol Treaty, and the presence of military ships, planes and helicopters from the United States “will transform Costa Rica into the largest naval base of the USA in this part of the world”, he indicated. 
 
On the other hand, the President of Congress, the officialist  José Luís Villanueva, said the legislative directory will study Fishman’s and Villalta’s considerations, as well as Chacón’s, and will give its opinion “first thing” this Wednesday.  
 
In case the legislators of the parties Liberación Nacional, Movimiento Libertario and Renovación Costarricense do not rectify, the case will be taken to the Constitutional Court, to validate other previous votes -and annul the permission to the massive entry of US military to Costa Rica. 
 
Meanwhile, lawyers have reminded that Resolution 07181-99, of the Constitutional Court in September 16 1999 - about the perceptive Consultation of constitutionality formulated by the Directory of Asamblea Legislativa- determined “It is clear that the present Treaty is strictly restricted to police activities, and exclusively dedicated to combat the illicit traffic of narcotics.  To this end, the participation of aircraft from the government of the US only concerns those activities proper of the Coast Guard Service of the said nation, dependent by definition on the Secretary of Transport of the USA, and not the Secretary of Defense, or any other”.  
 
“This also implies that, in the case of an armed conflict in which the USA sees itself involved, their aircraft and ships of its Coast Guard, along with its effectives who might be in Costarican territory, territorial waters or airspace in the fulfillment of the Treaty – will only be allowed to act in the work relevant to the meaning of the joint agreement-; and that the approval of this Treaty does not imply, under any circumstance, the acceptance of use of the Costarican territory, her territorial waters and her airspace, to any war effort whatsoever, or operations of any nature other than the object of the present agreement”. 
 
In the same vote, the magistrate Rodolfo Piza Escalante (Q.d.D.g), expressed “I don’t accept either the text of the protocol itself, that amends the Treaty; because the only constitutionally valid “entry and stay of foreign military ships or aircrafts in national territory” – is on the strict condition that the Asamblea Legislativa gives the corresponding permission on a case to case basis; (this, not necessarily because a military activity will take place, but because by International Law, the armed forces of another country exclude the application of National Laws); never an authorization of entry formulated as a blank check, and worse still, permission to carry on operations inside the country -an unacceptable concept, since it goes far beyond the competence the Constitution grants, even if it is to do a specific activity, like the prosecution of illegal drug trafficking”. 
 
In the sentencing, the Magistrate Carlos Manuel Arguedas had reasoned “Given the intention of the Treaty and the location of the bilateral cooperation in the strict field of what is relative to police force, the reference to what is established by incise 5) of Constitutional Article 121 –confirmed in the protocol- is out of place, or implies the possibility that foreign warships, in this case from the US (this, if not troops of that country), be used in the area of the Treaty.  This is, I repeat, contrary to what is established especially on the Article 12 of our Constitution, as I manifested in the separate note on the cited Resolution No. 04156-99. The equivocality, then, has not been cleared after this Resolution; instead it has confirmed, in my judgment, the possibility that the military apparatus of the USA could be used to take part in operations of illicit drug traffic suppression – or operations in support of those”.

Normally I would open this article by explaining this is the story the mainstream media won’t dare report. Except in this case, they are reporting it. It’s right on CNN, on the Anderson Cooper “360″ report.

What happened is that Lance Rosenfield, a photographer working for ProPublica (http://www.propublica.org), was standing on a public road, taking photos of a BP refinery in full public view. After taking his photos, he was tailed by local law enforcement officials to a gas station, where they demanded to look at the photos he had just taken. A private BP security goon then showed up at the scene, and an official from the Department of Homeland Security soon arrived and began to intimidate Lance.

With his wits about him (and some basic knowledge of the Bill of Rights), Lance at first refused to show his photographs to local law enforcement. They threatened to detain him (probably under the Patriot Act) if he didn’t, so he gave in and let them see the photos. Later, when private BP security personnel asked for Lance’s personal information, he refused to give it to them. So — get this — the police turned over his private information to the BP security goon!

Judge Hannes Winger summons Jane Burgermeister for hearing on August 12th to put her under court guardianship

Döbling Court Judge Hannes Winger signed the order to put me under court guardianship on July 3rd, a day or so after he must have recieved it from Judge Michaela Lauer, and in spite of the overwhelming evidence of misuse of the process to silence a person who has found evidence of fraud, Judge Winger has summoned Jane Burgermeister for an interview.

Mag Lauer justified her application, saying I was a crazy conspiracy theorist but as the appeal documents show, I had hard proof of her manipulation of the files.

For Judge Winger to just go ahead with an illegal order without checking exposs him to the charge of being part of an organised crime ring. I am delivering the documents to the court and will ask for a review and for the appointment to be cancelled immediately and for me to be notified by a certified letter of that cancellation.

Bilderberg member Roland Koch is set to replace Bilderberg member Angela Merkel as Chancellor of Germany in an elaborately choreographed piece of theatre to hoodwink the general public into believing they are being given a real choice when both Koch and Merkel work for the same corporate and banking interests, grouped around the Bilderbergs.

Koch resigned from his position as Prime Minister of Hesse  a few weeks ago to distance himself from the unpopular Merkel government, which has just slashed the budget to give yet more money to the banks under the guise of having to pay interest on paper debts. Now the German controlled mainstream media is paving the way for the return of Koch, presenting him as a knight in shining armour, who will reinvigorate the shattered CDU/CSU.

The Bilderbergs clearly do not think they can push through all the cuts with a nominal SPD leader Olaf Scholz as Chancellor. Nor can they go on with Merkel whose government has become one of the most unpopular in post war history.
