LAW PROFESSOR SAYS SCOTLAND HAS NO POWER TO BLOCK BREXIT. CAN THE UK PARLIAMENT BLOCK THE IMPLEMENTATION OF THE REFERENDUM?


Glasgow University Professor of Law Adam Tomkins has said on twitter the Scottish parliament does not have the power to block or veto a Brexit.

He said that the Scottish parliament can agree or not agree to Brexit but agreement was not the same as a veto.

“Holyrood has the power to show or to withhold its consent. But withholding consent is not the same as blocking,” he tweeted.

It also has to be asked if the UK parliament has the power to block the Brexit referendum result.

In Switzerland, referendum results are binding on the government.

It’s not just a legal issue. It’s a political issue.  For parliament to hold a referendum and then to dismiss the result is to undermine the most fundamental part of democracy, the will of the people, and therefore to undermine the legitimacy of parliament itself.

If the Swiss parliament would not in a thousand years dare consider voting to reverse the result of a referendum, you have to ask yourself what understanding of democracy do MPs in the UK parliament have who are calling for the Brexit to be blocked?
